Terms of Service

1. Eligibility

You must be at least 18 years old or have the consent of a legal guardian to use our services. You represent that all information you provide to us is accurate and complete.

2. Services Provided

Paradise Server Hosting LLC offers:

• Virtual Private Servers (VPS)
• Game Servers, including:
  • Minecraft
  • Rust
  • FiveM
  • Terraria

We reserve the right to modify, suspend, or terminate services at our discretion with reasonable notice.

3. Account Registration

To access services, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Acceptable Use Policy (AUP)

You agree not to use our services for:

• Hosting or distributing malware, spam, or other malicious software.
• Engaging in DDoS attacks or network abuse.
• Storing or transmitting illegal content (e.g., pirated media, child exploitation).
• Violating the intellectual property rights of others.
• Hosting unlicensed FiveM servers in violation of Rockstar's terms.

Paradise Server Hosting LLC reserves the right to suspend or terminate your services if you violate this policy.

5. Resource Usage

• Excessive CPU, disk I/O, or network usage that negatively impacts other customers may result in suspension or termination.
• Game server performance is shared across nodes. We will make best-effort attempts to ensure fair allocation.

6. Payment and Billing

• All services are billed on a recurring basis (monthly, quarterly, or annually).
• Payments are due in advance. Non-payment may result in service suspension after 3 days of delinquency and termination after 7 days.
• All prices are in USD and exclusive of applicable taxes.
• No refunds will be issued for terminated services due to a TOS or AUP violation.

7. Refund Policy

• Refunds may be requested within 48 hours of your initial purchase for first-time customers only.
• Refunds are not provided for renewal payments, service abuse, or accounts found in violation of our TOS or AUP.

8. Backups and Data Loss

• We do not guarantee backups of your data. Customers are responsible for maintaining their own backups.
• Paradise Server Hosting LLC is not liable for any data loss, service interruption, or damages arising from the use or inability to use our services.

9. Service Uptime

We strive for uptime but do not guarantee uninterrupted service. Maintenance windows or unforeseen outages may occur. We will communicate major outages via our status page or email.

10. Third-Party Software

You are solely responsible for the installation, licensing, and use of any third-party software installed on your server, including compliance with the software's license terms.

11. Limitation of Liability

To the maximum extent permitted by law:

• Paradise Server Hosting LLC shall not be liable for any indirect, incidental, or consequential damages.
• Our total liability for any claim arising out of your use of our services shall not exceed the total amount paid by you in the past 3 months.

12. Indemnification

You agree to indemnify and hold harmless Paradise Server Hosting LLC and its affiliates from any claims, damages, or losses resulting from your use of our services or violation of these Terms.

13. Termination

We may terminate your account with or without notice for violations of our Terms or AUP. You may cancel your service at any time via your client portal.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of law provisions.

15. Modifications

We reserve the right to update or change these Terms at any time. Changes will be posted on our website. Continued use of our services after changes constitute your acceptance of the new Terms.
